Rules applicable to buyers on the platform.
This document aims to frame the relationship between your company (the Buyer) and your supplier BACKDOZER.
These GTC define the terms and conditions applicable to the purchase of goods and services by the Buyer from the Supplier BACKDOZER, within the operation of its online heavy equipment sales platform.
Any order placed by the Buyer implies unconditional acceptance of these GTC by the Supplier. No special condition may prevail over the GTC without the formal written acceptance of the Buyer.
Purchases are made by online validation on the platform www.backdozer.com.
The Supplier commits to confirm the purchase on www.backdozer.com. The Buyer agrees to arrange payment for confirmed purchases on the platform within 7 days by bank transfer.
Prices confirmed online are final, in Euros, excluding taxes, and include all Backdozer site commissions. Additional fees related to these purchases will be added to the total purchase price (for example, a documentation fee of 35 EUR will be charged for each item purchased).
All payments are due upon confirmed online purchase, starting from the date of receipt of the proforma invoice, by bank transfer, within 7 days. All purchases are by default accepted in EURO. If a foreign buyer pays in a currency other than EURO, they will bear the exchange and EURO transfer fees to Backdozer.
Any confirmed purchase paid by credit card in advance will incur additional banking fees. If full payment is not received within seven (7) days from the online purchase validation date, your credit card may be automatically charged and service fees will apply to the transaction.
In case of late payment, penalties calculated at 2.5% of the total amount per day of delay will apply, without any reminder being necessary.
Deliveries are made to the address provided by the Buyer during the order.
The Supplier guarantees that the equipment complies with the specifications validated at the time of purchase and is free from defects unknown to Backdozer.
As equipment purchases are occasional, Backdozer acts as an intermediary between supplier partners and buyers. Backdozer ensures transparency of all products offered for sale between the parties. Backdozer shall not be held responsible for unknown damages, hidden defects, or omissions not reported by the partner seller. However, Backdozer undertakes to facilitate dispute resolution.
The Supplier agrees to keep all information obtained from the Buyer during the purchase confidential.
This obligation remains in effect for one year after the completion of the purchase.
Any dispute related to the use of backdozer.com is governed by French law and falls under the exclusive jurisdiction of the courts of Lyon, France.
If any clause of these GTC is found invalid, the remaining provisions remain in effect.
The Buyer’s failure to invoke a clause does not imply waiver of its benefit.
